Madde 1: Taraflar ve Hizmetin Amacı İşbu sözleşme, Borsa Radarım (Bundan sonra 'Platform' olarak anılacaktır) ile platform hizmetlerinden yararlanan kullanıcı (Bundan sonra 'Üye' olarak anılacaktır) arasında akdedilmiştir. Platform; finansal piyasalara yönelik teknik analiz stratejileri, eğitim içerikleri, model portföy paylaşımları ve anlık alarm/bildirim hizmetleri sunan bir dijital üyelik platformudur.Madde 2: Yatırım Danışmanlığı Sorumluluk Reddi (ÖNEMLİ)Platformda sunulan hiçbir içerik, grafik, analiz, tablo, model portföy veya yorum 6362 sayılı Sermaye Piyasası Kanunu ve ilgili mevzuat kapsamında "Yatırım Danışmanlığı" faaliyeti teşkil etmez.
Sunulan stratejiler ve anlık bildirimler, geçmiş veriler ve teknik analiz metotları kullanılarak hazırlanmıştır. Hiçbir strateji gelecekteki kârı garanti etmez. Üye, alarmları ve stratejileri kendi hür iradesiyle değerlendirdiğini kabul eder.Platform tarafından sağlanan bilgiler sadece eğitim ve teknik analiz bilgilendirmesi amaçlıdır. "Al, sat, tut" tavsiyesi değildir.Finansal piyasalar yüksek risk içerir. Üye, platformdaki verileri kullanarak alacağı yatırım kararlarının sonuçlarından (kâr veya zarar) bizzat sorumludur. Borsa Radarım, Üye'nin uğrayabileceği maddi veya manevi zararlardan hiçbir şekilde sorumlu tutulamaz.Madde 3: Kullanım Şartları ve Hesap GüvenliğiÜyelik hakları kişiye özeldir. Üye, kullanıcı adı ve şifresini üçüncü şahıslarla paylaşamaz.Bir üyeliğin birden fazla kişi tarafından kullanıldığının (eş zamanlı farklı IP girişleri vb.) tespit edilmesi durumunda, Platform üyeliği tazminatsız olarak sonlandırma hakkını saklı tutar.Madde 4: Fikri Mülkiyet HaklarıPlatformda sunulan tüm stratejiler, yazılımlar, videolar ve özel analizler Borsa Radarım’ın mülkiyetindedir. Bu içeriklerin kopyalanması, ekran görüntüsü alınarak paylaşılması veya başka platformlarda yayınlanması yasaktır. İhlal durumunda yasal işlem başlatılacaktır.Madde 5: Abonelik, Fiyat Değişiklikleri, İptal ve İade Koşullarıİade Politikası: Hizmetimiz "elektronik ortamda anında ifa edilen dijital içerik" kapsamında olduğundan, aktive edilen mevcut dönem için ücret iadesi yapılmamaktadır.İptal: Üye, aboneliğini dilediği zaman iptal edebilir. İptal işlemi gerçekleştiğinde, Üye ödemesini yaptığı dönemin sonuna kadar hizmeti kullanmaya devam eder; ancak yeni dönemde kartından çekim yapılmaz.ÖNEMLİ: Platforma giriş yapılmaması, Telegram grubundan çıkılması (Leave Group) veya bildirimlerin kapatılması abonelik iptali anlamına gelmez. Üye, bizzat yönetim paneli üzerinden "Aboneliği İptal Et" butonunu kullanmadığı sürece; hizmeti fiilen kullanmasa dahi aboneliğinin devam edeceğini ve ödemelerin tahsil edileceğini peşinen kabul ve beyan eder.Fiyat Değişiklikleri: Platform, piyasa koşulları ve maliyet artışlarına bağlı olarak üyelik ücretlerinde güncelleme yapma hakkını saklı tutar. Yapılacak fiyat değişiklikleri, Üye'ye e-posta veya site içi bildirim yoluyla en az 30 (otuz) gün önceden bildirilecektir. Fiyat artışı, Üye'nin içinde bulunduğu ödeme dönemini etkilemez; bir sonraki yenileme döneminde yürürlüğe girer. Üye, yeni fiyatı kabul etmediği takdirde, yenileme tarihinden önce aboneliğini ücretsiz iptal etme hakkına sahiptir. Belirtilen sürede iptal edilmeyen abonelikler, güncel fiyat üzerinden yenilenmiş sayılır.Madde 6: Yetkili Mahkemeİşbu sözleşmeden doğacak ihtilaflarda Estonya mahkemeleri ve yasaları yetkilidir.Madde 7:Yasal Bildirim ve Yürürlük İşbu sözleşme, üyenin kayıt olmasıyla yürürlüğe girer. Platform üzerindeki tüm yasal sorumluluk, faturalandırma ve hizmet sağlayıcılığı Estonya yasalarına tabi Nordateks OÜ (Tallinn, Estonia) tüzel kişiliğine aittir.

Article 1: Parties and Purpose of Service This agreement is entered into between Borsa Radarım (hereinafter referred to as the "Platform") and the user benefiting from the platform services (hereinafter referred to as the "Member"). The Platform is a digital membership platform providing technical analysis strategies, educational content, model portfolio shares, and instant alarm/notification services for financial markets.Article 2: Investment Advisory Disclaimer (IMPORTANT)No content, graphics, analysis, tables, model portfolios, or comments provided on the Platform constitute "Investment Advisory" activities within the scope of Capital Markets Law No. 6362 and related legislation.The strategies and instant notifications provided have been prepared using historical data and technical analysis methods. No strategy guarantees future profits. The Member acknowledges that they evaluate alarms and strategies of their own free will.The information provided by the Platform is for educational and technical analysis information purposes only. It is not "buy, sell, hold" advice.Financial markets involve high risk. The Member is personally responsible for the outcomes (profit or loss) of investment decisions made using the data on the platform. Borsa Radarım cannot be held liable for any material or moral damages incurred by the Member.Article 3: Terms of Use and Account SecurityMembership rights are personal to the individual. The Member may not share their username and password with third parties.In the event that the use of a single membership by more than one person is detected (e.g., simultaneous logins from different IP addresses), the Platform reserves the right to terminate the membership without compensation.Article 4: Intellectual Property RightsAll strategies, software, videos, and private analyses presented on the platform are the property of Borsa Radarım. Copying, sharing via screenshots, or publishing this content on other platforms is strictly prohibited. Legal action will be initiated in case of violation.Article 5: Subscription, Cancellation, Price Changes and Refund PolicyRefund Policy: Since our service falls under the category of "digital content delivered instantly in an electronic environment," no refunds are provided for the currently activated period.Cancellation: The Member may cancel their subscription at any time. Upon cancellation, the Member continues to use the service until the end of the paid period; however, no charges will be made for the new period.IMPORTANT: Not logging into the Platform, leaving the Telegram group, or turning off notifications does not constitute a cancellation of the subscription. The Member explicitly accepts and declares that unless they perform the formal cancellation via the "Cancel Subscription" button on the management panel, the subscription will continue and payments will be collected, even if the service is not actively used.Price Changes: The Platform reserves the right to update membership fees based on market conditions and cost increases. Any price changes will be notified to the Member via email or on-site notification at least 30 (thirty) days in advance. The price increase does not affect the Member's current billing period; it becomes effective in the next renewal period. If the Member does not accept the new price, they have the right to cancel their subscription free of charge before the renewal date. Subscriptions not canceled within the specified period will be deemed renewed at the current price.Article 6: Authorized CourtEstonian courts and laws shall have jurisdiction over any disputes arising from this agreement.Article 7: Legal Notice and Enforcement This agreement enters into force upon the member's registration. All legal responsibility, billing, and service provision on the Platform belong to the legal entity Nordateks OÜ (Tallinn, Estonia), subject to Estonian laws.
